ASIA HOLIDAY VILLA is a private villa rental company under licenses “PT. HUB TECH INDONESIA” Each time a guest books a property through ASIA HOLIDAY VILLA, the guest is deemed to have agreed to these terms and conditions. The rental contract is not effective until Asia Holiday Villa has confirmed the booking in writing.

Booking a private villa is very different from booking a regular hotel room, especially with regard to payments and cancellations. Please read the following conditions carefully.

  1. PAYMENT

When the Guest makes a booking request, the Guest must make the appropriate deposit payment to Asia Holiday Villa within 5 working days of availability confirmation. If the required deposit payment is not received within the 5 working day period, Asia Holiday Villa reserves the right to void the Guest’s booking request. The following deposit payment applicable to most villas.

  • For rentals beginning more than 75 days after the date of the booking request – a deposit of 50% of the total rental amount is payable
  • For rentals beginning 75 days or less after the date of the booking request – the total rental amount is payable as a deposit

Where a 50% deposit applies to the booking, the Guest must pay the remaining 50% balance not less than 75 days before the scheduled arrival date.

  1. PAYMENT METHOD

International telegraphic transfer to our corporate bank account normally takes about three days. The amount transferred must include telegraphic transfer fees. If you choose to settle your payment by bank transfer, make sure that you allocate sufficient time before the due date. In the case you are aware that your transfer payment may not reach our account in time, promptly notify us by sending emailed scan of your transfer instruction receipt. Make sure that the receipt has bank’s authorization print-out. We have to receive the payment in full into our account. In the case of arriving payment is slightly less than required in the invoice because of transfer fee, bank’s charge, currency loss, etc. You are required to pay the remainder either along with your final payment (if you are paying deposit) or in cash upon arrival.

  1. ADDITIONAL COSTS

The cost of electricity, mains water, cleaning and garden supplies, and also local taxes are included in our villas rental rates. There are generally no additional costs, surcharges, taxes, staff salaries, or management fees above the price quoted unless otherwise stated in the property description, the guest booking confirmation, or reservation voucher. If the information in any of these is inconsistent, the most recently issued terms will prevail. Typically telephone and internet charges and provisioning costs will be the guest’s responsibility. Gratuities for household staff are encouraged and normal, but are left entirely to the guest’s discretion.

     4. RESERVATION VOUCHER

Confirmation details, the villa address, contact details of the villa manager, transfer arrangements, and directions to the property will be sent to the guest in a reservation voucher when full payment is received. This voucher along with the guest’s passport is needed to be presented upon arrival.

  1. ARRIVAL / DEPARTURE TIMES

Typical check-out and check-in times are 02:00 pm and 3:00pm respectively unless stated otherwise. Asia Holiday Villa will work with  villas owner or owner’s representative to accommodate the guest’s actual arrival and departure times, and also subject to availability. Please do advise Asia Holiday Villa of any changes to the guest’s schedule so every effort can be made to accommodate them.

       6. SECURITY DEPOSIT 

A security deposit may be payable directly to the Villa manager immediately upon arrival at your selected villa. The standard security deposit required for each private property is stated in the property description; however, the owner has the right to impose different requirements on a case by case basis. Access to the property may be refused if the security deposit is not paid in full. When the security deposit is required to be paid in cash, or when a non-standard security deposit applies, Asia Holiday Villa will inform the guest in advance of the amount payable and any other conditions. The security deposit will be normally refunded at the end of the rental period, after deducting: all additional expenses incurred on the guest’s behalf (e.g. additional charges for goods, services and staff, which have not been directly paid by the guest, and telephone charges, if applicable) and the cost of replacement or repair for any loss or damage to the property or its surrounds or contents caused during the rental period. If this cost cannot be reasonably determined prior to the guest’s departure, the owner or the owner’s representative is entitled to withhold a reasonable estimate from the guest’s security deposit and will return any balance to the guest as soon as possible after the actual cost has been determined.

  1. DAMAGE OR LOSSES

A villa property is typically someone’s home. Please treat villas property rented accordingly, and leave the property and all its contents in good order and in an acceptably clean condition. Any damage or losses caused during the rental period, as well as any special cleaning requirements will be the guest’s responsibility and may be charged to the guest’s account and deducted from the guest’s security deposit. In cases of excessive or unacceptable loss or damage at any time during the rental period, the owner or owner’s representative may require the guest and their party, including visitors to vacate the property immediately, without compensation or refund.

  1. ACCESS

The property and its facilities are available for the guest’s full enjoyment during the rental period. However owner, owner’s representative, or other staff and contractors may need access to the property from time to time (e.g. for maintenance purposes to the house, garden, swimming pool, utilities and services, or for the purposes of providing additional services requested by the Guest, etc). The guest is required to give them reasonable access to the property for these purposes.

  1. NUMBER OF GUESTS

The number of persons (adults and children) staying at property must not exceed the maximum number of sleeping places indicated in the booking confirmation and reservation voucher, unless specifically authorized in writing. Exceeding this number may invalidate any insurance policy. Entry or access to property may be refused or limited where the number of guests exceeds the stated requirement. No pets are allowed unless agreed in writing in advance.

  1. USE OF PROPERTY

All bookings are assumed to be for normal holiday purposes only, and the Guest agrees that the use of the Property will be limited to this purpose unless otherwise confirmed in writing. If the Guest is planning to hold an event, such as a wedding or party, which involves having a larger number of people at the Property, or if the Guest is planning to use the Property for a purpose other than holiday, please communicate this to Asia Holiday Villa at the time of booking, as special approval or arrangements may be required. Please note that same-sex wedding ceremonies of any kind will not be accepted for properties in Indonesia to avoid potentially offending prevailing local customs and last-minute disruptions to guest plans. Depending on the nature of the event, a surcharge and/or additional security deposit may be required, which will be agreed and confirmed in writing prior to confirming the reservation. Note that some Properties are in residential areas or estates, and some are subject to rules and regulations regarding their use. Therefore, it may not always be possible to grant permission for certain uses or activities due to these or other reasons beyond the control of Asia Holiday Villa and the Owner.

If Asia Holiday Villa has confirmed a booking which includes an event at the Guest’s chosen Property, in certain circumstances the Guest must then obtain permits from the police and the local community before the event can proceed. The Guest acknowledges and agrees that Asia Holiday Villa, the Owner and the Owner’s Representative cannot control the issue of these permits. If the police and/or the local community refuse to issue a permit for an event at the Property, the Owner or the Owner’s Representative will refund any event fee paid by the Guest to the Owner, however, neither Asia Holiday Villa, the Owner nor the Owner’s Representative will be liable for any further refund or payment to the Guest.

  1. CONDUCT AND DUE CARE

Properties are generally located in quiet residential neighborhoods. The guest is asked to respect this, and ensure that all guests and visitors to property behave appropriately. Illegal or immoral activities including gambling, prostitution, prohibited drugs, possession or use of pyrotechnics or dangerous goods, and possession or use of firearms and other weapons are all strictly prohibited. Smoking is generally prohibited unless stated otherwise in the booking confirmation or reservation voucher. The guest is responsible for the behavior of the guests staying at property, as well as visitors to the property during the rental period. Should any guest(s) or visitor(s) are not behave in a suitable manner, the owner or the owner’s representative may, in their absolute discretion, require the Guest, their party and/or visitor(s) to leave the premises and/or vacate the property immediately, without compensation or refund. In the interests of safety, due care should be taken at the property at all times, especially with children. Suitable supervision should be given around pools, beaches and roads, and when using all property’s facilities.

  1. VALUABLES AND SECURITY

Any guest valuables or properties left or used at the property are at the guest’s own risk. Neither Asia Holiday Villa, owner, nor villa management accepts any responsibility for loss of or damage to guest property. The guest is responsible for the property during the rental period, and must ensure that all windows and doors are locked securely when not on the premises. Any act or omission by the guest, their party and/or visitors which may negate or prejudice the property’s insurance policy and/or results in loss or damage is the guest’s responsibility. So be careful with your valuables and take care of your selected villas.

  1. PRICE FLUCTUATION

Once the guest’s booking is confirmed, the price of the guest’s reservation is fully guaranteed, even if Asia Holiday Villa changes the price on its website after the guest’s booking has been confirmed. In return for this commitment, no refunds will be made for any exchange rate fluctuations that would otherwise reduce the rental cost. Asia Holiday Villa reserves the right to impose any taxes or other charges which may be implemented by any government or other regulatory body, which were unknown at the time of publishing. Asia Holiday Villa will tell the guest promptly in the unlikely event that it becomes aware that any taxes or charges will apply to the guest’s booking. We ensure you will have your own selected villa in Bali with fix budget.

  1. CANCELLATIONS

If the guest wishes to cancel a confirmed booking, the written notice of cancellation must be sent to Asia Holiday Villa. All cancellation notices received by Asia Holiday Villa will be acknowledged in writing. It is strongly recommended that the guest and all members of the guest’s party purchase trip cancellation insurance. Cancellation of a booking includes but is not limited to: Cancellation of one or more days of a booking; An amendment of a booking so that none of the dates of the booking once amended fall within the same dates that originally constituted the booking; Failure of all guests to provide the required documentation on arrival (eg. Passports or suitable identification); and Attempt by the guest, their party or visitors to hold an event at property in breach of these Terms and Conditions or breach of any rules applicable to the guest’s chosen property. In the event that the guest cancels a confirmed booking, the following cancellation fees will generally apply:

  • 25% of the total rental amount will be forfeited if the cancellation is made more than 60 days before the start of the rental period
  • 50% of the total rental amount will be forfeited if the cancellation is made between 30 and 60 days before the start of the rental period
  • 100% of the total rental amount will be forfeited if the cancellation is made between 1 and 29 days before the start of the rental period.
  • For no-show: 100% of the total rental amount will be forfeited
  • For Special Price Non-refundable is applied
  1. AMENDMENTS

Once a booking confirmation is issued by Asia Holiday Villa, a fee of USD 50 will apply to each amendment made. Asia Holiday Villa will do its best to accommodate any reasonable amendments, but the guest should be aware that some changes may not be possible. Please note that these amendment policies apply for regular booking periods. Special amendment terms may apply for peak/high seasons and will be stated in the property description, booking confirmation or reservation voucher. If the information in any of these is inconsistent, the most recently issued terms will prevail. In the unlikely event that Asia Holiday Villa is unable for any reason (including the sale of a property and force majeure) to provide the guest with the property booked by guest, Asia Holiday Villa reserves the right to transfer the guest and their party to an alternative property with similar type and value, in consultation with the guest. If the price of substituted property is less than the original booking, the difference will be reimbursed to the guest. If the price of the substituted property is higher than the original booking, the difference may be charged to the guest. However, after considerable effort by Asia Holiday Villa, no alternative of similar type and value is available, and/or no agreement can be reached between the guest and Asia Holiday Villa, then either Asia Holiday Villa or the guest may opt to cancel the booking and rental contract. In that event, Asia Holiday Villa will refund all cost that guest already paid, without further compensation.

16. COMPLAINTS

Every attempt will be made for the guest to have an enjoyable stay. If the guest have a problem during rental period, please inform the owner or the owner’s representative immediately, who will endeavor to put things right. If owner or owner’s representative does not address the guest’s problem satisfactorily, please contact Asia Holiday Villa promptly. In order for the guest’s complaint to be addressed, the guest must communicate any problem whilst on location. If no complaint is reported during the rental period, Asia Holiday Villa and the owner will assume that the property was to the Guest’s satisfaction and no complaint will be entertained.

17. PROVISIONS

Self-catering accommodations require that the guest supply all provisions and consumables necessary for daily living. The staff at property may accommodate any reasonable requests to purchase provisions on the guest’s behalf, and this will be charged to the guest’s account.

18. ASIA HOLIDAY VILLA’S RESPONSIBILITY

The descriptions, assessments and/or ratings of Properties and surrounding locations that Asia Holiday Villa publishes or gives to the guest are provided in good faith and in the belief that they are accurate based on the latest information received. However, Asia Holiday Villa cannot be held responsible for any modifications to the properties or inaccuracies. Where Asia Holiday Villa publishes or refers to descriptions, assessments and/or ratings of the property either by Asia Holiday Villa or by third parties, these ratings are for information purposes only and Asia Holiday Villa will not be held responsible for any reliance placed on these ratings.

  1. DISCLAIMERS

Neither Asia Holiday Villa, the owner nor the villa management accepts any responsibility or liability for: any physical injury, sickness, death, loss, damage, inconvenience or additional expenses incurred by the guest, their party, or visitors regardless of the cause; any vehicle or the contents of any vehicle used, hired or engaged by the guest or their party during rental period; Inability of the guest or any member of the guest’s party to enter the location of the property or stay at the property for all or part of the rental period as a result of failure to obtain appropriate travel or visa documentation, cancellation, amendments to travel arrangements. the missing of flights, or travel connections; and/or any delay or cancellation of the booking as a result of war, threat of war, riot or civil strife, strike, demonstration, terrorist activity (threatened or actual), natural disaster, fire, sickness, weather conditions, action at an airport or port by any government or public authority, technical problems relating to transport and airport regulations caused by technical, mechanical or electrical breakdowns, or any technical, structural, electrical, plumbing or other problems with animals around the property or difficulties with the Property which make it unsafe or unusable, or any other circumstances which amount to ‘force majeure’ or Acts of God, or other events beyond the Owner’s control. In no case will Asia Holiday Villa, owner or villa management or collectively be liable to make any payment or give any refund or compensation of any amount over and above the total rental amount paid.

20. JURISDICTION

This agreement will be governed by the laws of INDONESIA. In the event of controversy arising from the booking and property rental that cannot be resolved amicably between the parties, both parties agree to exclusively refer the matter to the court of Indonesia to be resolved. By making its booking request, the guest agrees that these terms and conditions have been read, understood and have been accepted and agreed to by the guest without reservation and without exception. If any of the conditions of this rental contract are or become or are deemed to be invalid, or if there is any omission from any terms and conditions, the remaining terms and conditions will remain valid and enforceable and cannot be contested.

Memesan Villa Pribadi sangatlah berbeda dengan memesan kamar hotel pada umumnya, terutama terkait pembayaran dan pembatalan. Mohon membaca dan memahami syarat dan ketentuan berikut dengan seksama.

Asia Holiday Villa adalah agen untuk promosi dan pemesanan properti dalam hal ini premium villa. Setiap kali pemesan mengkonfirmasi pemesananan kamar/villa melalui Asia Holiday Villa, maka pemesan menyetujui “Kontrak Rental” dalam masa yang telah ditentukan (Masa Sewa Villa). Pemesan diminta menyetujui Syarat dan Ketentuan ini. Kontrak Rental berlaku efektif sejak Asia Holiday Villa mengkonfirmasi pemesanan kamar dan mengirimkan Konfirmasi Pemesanan resmi kepada pemesan.

  1. PEMBAYARAN

Ketika pemesan melakukan pemesanan kamar, pemesan diwajibkan memberikan deposit sesuai jumlah yang telah ditentukan kepada Asia Holiday Villa dalam jangka waktu 5 hari kerja semenjak konfirmasi pemesanan. Apabila dalam waktu 5 hari kerja Pemesan tidak melakukan pembayaran deposit, Asia Holiday Villa berhak membatalkan permintaan pemesan. Pembayaran deposit  berikut berlaku untuk sebagian besar Villa :

–          Untuk pemesanan dengan tanggal Check in lebih dari 75 hari sejak tanggal konfirmasi pemesanan – 50% dari total pembayaran harus dibayarkan. Kekurangan pembayaran harus dibayarkan tidak kurang dari 75 hari sebelum tanggal Check in.

–          Untuk pemesanan dengan tanggal Check in sama atau kurang dari 75 hari sejak tanggal konfirmasi pemesanan –  Pemesan harus memberikan Pembayaran secara penuh sesuai dengan jumlah total biaya pemesanan.

  1. METODE PEMBAYARAN

Transfer melalui bank luar negeri ke rekening kami akan memakan waktu 3 hari kerja Apabila pemesan memilih menggunakan opsi ini, pemesan harus menyediakan waktu yang cukup sebelum batas waktu pembayaran. Apabila pembayaran dirasakan memakan waktu lebih dari batas waktu yang telah ditentukan, mohon mengirimkan kami bukti transfer yang resmi dari bank pemesan. Jumlah transfer harus termasuk biaya transfer sehinggal jumlah yang kami terima sesuai dengan biaya pemesanan. Apabila jumlah yang kami terima kurang dari jumlah yang telah ditentukan, maka pemesan diwajibkan melunasi kekurangan pada saat pembayaran sisa deposit (apabila pemesan melakukan pembayaran deposit) atau secara tunai pada saat kedatangan.

  1. BIAYA LAINNYA

Biaya listrik, air, jasa kebersihan, dan pajak (lokal) termasuk didalam harga villa-villa kami. Tidak ada biaya tambahan lain seperti, pajak, gaji staff dan sejenisnya kecuali telah diinformasikan di deskripsi villa terkait, konfirmasi pemesanan atau reservation voucher. Apabila salah satu informasi ini tidak jelas, maka informasi terbaru yang berlaku. Pada umumnya biaya telepon, internet , dan biaya provisi menjadi tanggung jawab pemesan. Tips untuk staff adalah normal namun diserahkan sepenuhnya kepada keinginan pemesan

  1. VOUCHER PEMESANAN

Detail pemesanan, alamat villa, nomor kontak manajer villa, detail penjemputan, dan arahan menuju villa akan dikirimkan didalam voucher pemesanan ketika pemesan telah melakukan pembayaran villa secara penuh. Voucher ini harus disertakan bersama dengan paspor pemesan pada saat kedatangan.

  1. JAM CHECK IN / CHECK OUT

Standar Check Out dan Check in Time adalah  12.00 PM dan 03.00 PM kecuali ada keterangan spesifik lainnya. Asia Holiday Villa bersama pemilik Villa atau Representatif akan berusaha mengakomodasi tamu sesuai jam check in / out tergantung ketersediaan kamar. Mohon menginformasikan Asia Holiday Villa apabila ada perubahan terkait jadwal tamu untuk proses check in /out yang lancar.

  1. SECURITY DEPOSIT

Deposit dapat dibayarkan langsung kepada pemilik atau perwakilan pemilik Villa pada saat kedatangan. Jumlah deposit yang diperlukan telah tertera di di masing – masing deskripsi Villa, namun pemilik villa berhak mengajukan perubahan tergantung dari keadaan (case to case basis) . Tamu mungkin tidak akan diijinkan memasuki properti apabila Security Deposit tidak dibayarkan  secara penuh. Apabila Villa memerlukan deposit dalam bentuk tunai atau memerlukan deposit diluar jumlah standar, Asia Holiday Villa akan menginformasikan kepada tamu sebelumnya mengenai dengan jumlah dan informasi terkait lainnya. Security Deposit akan di kembalikan pada akhir periode menginap setelah dikurangi dengan : semua pengeluaran tambahan untuk tamu (contohnya : biaya tambahan, servis & staff , yang tidak dibayarkan secara langsung oleh tamu, telepon dan internet , apabila dikenakan) dan biaya perbaikan atau penggantian apabila ada kehilangan atau kerusakan barang – barang didalam properti yang terjadi selama tamu menginap. Apabila jumlah nya tidak bisa di kalkulasi sebelum tamu meninggalkan property maka pemilik berhak menahan Security Deposit sementara sampai jumlah pasti untuk kerugian telah di ketahui dan mengembalikan sisa dari deposit tersebut kepada tamu yang bersangkutan.

  1. KERUSAKAN ATAU KEHILANGAN

Villa sewaan pada dasarnya adalah properti milik orang lain. Maka dari itu mohon menjaga Villa dan barang – barang didalamnya agar tetap dalam keadaan baik sampai masa penyewaan berakhir. Semua kerusakan atau kehilangan yang terjadi pada saat tamu menyewa villa terkait, termasuk apabila ada perbaikan khusus yang harus dilakukan akan menjadi tanggung jawab tamu yang bersangkutan akan di tagihkan kepada tamu dan dikurangi dari Security Deposit yang diberikan. Dalam kasus kehilangan atau kerusakan yang berat selama masa sewa, pemilik atau perwakilan dari pemilik Villa dapat meminta tamu termasuk undangannya untuk meninggalkan properti tanpa kompensasi atau pengembalian dana.

  1. AKSES

Villa dan fasilitasnya tersedia sepenuhnya untuk penyewa. Namun pemilik, perwakilan pemilik atau staff mungkin akan memerlukan akses ke properti dari waktu ke waktu (contoh : untuk perbaikan properti, taman, kolam renang, fasilitas atau untuk menyediakan layanan tambahan yang diperlukan penyewa , dan lain-lain). Maka dari itu penyewa diminta untuk memberikan akses untuk tujuan yang telah disebutkan diatas.

  1. JUMLAH TAMU

Jumlah tamu (Dewasa dan Anak-anak) yang menginap tidak boleh melebihi kapasitas maksimum properti yang telah tertera di konfirmasi pemesanan , kecuali telah di konfirmasi secara tertulis. Melebihi jumlah yang ditentukan dapat menyebabkan tidak validnya asuransi dari Villa di Bali. Akses masuk kedalam properti mungkin akan di tolak atau dibatasi sesuai dengan jumlah tamu yang telah disetujui di awal. Membawa peliharaan dilarang kecuali telah disetujui secara tertulis sebelumnya.

  1. PENGGUNAAN PROPERTI

Semua pemesanan akan di asumsikan untuk tujuan liburan saja, dan penyewa menyetujui bahwa penggunaan property / villa hanya untuk tujuan ini saja kecuali ada persetujuan lain secara tertulis. Apabila penyewa berencana untuk mengadakan acara seperti Pernikahan atau Pesta, yang mengikutsertakan banyak orang / tamu di dalam property , atau apabila penyewa berencana untuk menggunakan Villa untuk tujuan selain liburan, mohon mengkonfirmasikan terlebih dahulu kepada Asia Holiday Villa pada saat akan memesan property yang diinginkan, karena persetujuan khusus akan diperlukan. Mohon untuk diingat bahwa pernikahan sesama jenis tidak diijinkan di Indonesia untuk menghindari permasalahan dengan hukum di Indonesia dan gangguan lainnya. Tergantung dari jenis acara, biaya tambahan atau tambahan security deposit mungkin akan diperlukan, hal ini akan di informasikan kepada penyewa sebelum konfirmasi pemesanan. Mohon diingat bahwa beberapa property berada dilingkungan penduduk dan beberapa memerlukan ijin untuk mengadakan acara tertentu. Maka dari itu, tidak semua permintaan Event dapat di kabulkan karena merupakan diluar kontrol Asia Holiday Villa / pemilik.

  1. CONDUCT AND DUE CARE

Properti kami pada umumnya terletak di lingkungan yang tenang. Penyewa diharapkan untuk respek terhadap lingkungan disekitarnya, dan memastikan semua tamu and pengunjung Villa  bersikap sewajarnya. Aktivitas Ilegal atau immoral termasuk perjudian , prostitusi, penggunaan obat-obatan terlarang, kepemilikan atau penggunaan peralatan berbahaya, kepemilikan atau penggunaan senjata api dan senjata lainnya tidak diperbolehkan. Merokok pada umumnya diijinkan kecuali tertera sebaliknya di konfirmasi pemesanan /voucher pemesanan. Penyewa bertanggung jawab atas segala perilaku tamu selama menginap, termasuk para pengunjungnya selama periode menginap. Apabila satu atau lebih tamu atau pengunjung berperilaku tidak sepantasnya, Pemilik atau perwakilan pemilik berhak secara penuh dan mutlak untuk meminta penyewa, tamu mereka dan pengunjung untuk meninggalkan properti segera tanpa kompensasi atau pengembalian pembayaran. Demi alasan keamanan, mohon berhati – hati selama beraktifitas di dalam properti terutama dengan anak – anak. Pengawasan yang sesuai wajib diberikan di area kolam renang, pantai atau jalan raya, dan ketika menggunakan semua fasilitas Villa.

  1. BENDA BERHARGA DAN KEAMANAN

Segala benda berharga milik penyewa dan properti yang digunakan di dalam properti akan menjadi tanggung jawab penyewa. Asia Holiday Villa, pemilik, atau manajemen villa tidak akan bertanggungjawab atas rusak atau hilangnya barang milik penyewa. Penyewa bertanggungjawab terhadap properti selama masa sewa, dan wajib memastikan semua jendela dan pintu terkunci dengan aman ketika tidak sedang berada di lingkungan villa. Segala perilaku tamu, atau pengunjung tamu yang berkemungkinan meniadakan atau mengurangi kebijakan asuransi properti dan / atau mengakibatkan kerugian atau kerusakan adalah tanggung jawab tamu. Maka mohon berhati – hati dengan barang berharga anda dan mohon memperlakukan properti selama anda menginap dengan baik

  1. FLUKTUASI HARGA

Ketika pemesanan tamu di konfirmasi, harga yang diterima oleh tamu telah terjamin, bahkan ketika Asia Holiday Villa mengganti harga Villa terkait di Website setelah konfirmasi pemesanan. Sebaliknya, tidak ada refund yang akan diberikan apabila terjadi fluktuasi harga yang dapat mengurang harga sewa Villa. Asia Holiday Villa berhak untuk mengenakan pajak atau biaya lain yang ditetapkan oleh pemerintah atau badan pengatur lainnya, yang tidak diketahui pada saat penerbitan. Asia Holiday Villa akan memberi tahu tamu segera jika ada pajak atau biaya yang akan dikenakan untuk pemesanan tamu. Kami memastikan Anda akan memiliki villa pilihan Anda sendiri di Bali dengan harga yang tetap.

  1. PEMBATALAN

Apabila tamu ingin membatalkan pemesanan, tamu harus mengirimkan permintaan pembatalan secara tertulis kepada Asia Holiday Villa. Segala pembatalan yang diterima oleh Asia Holiday Villa akan ditangani secara tertulis. Kami sangat menyarankan agar tamu dan seluruh koleganya untuk memiliki asuransi pembatalan perjalanan. Pembatalan pemesanan termasuk tapi tidak terbatas untuk : pembatalan satu atau lebih hari dari pemesanan awal : Perubahan pemesanan sehingga tanggal pemesanan sama sekali berbeda dengan konfirmasi awal: Tamu tidak mampu untuk menunjukkan dokumen yang diperlukan pada saat kedatangan. (Seperti passport atau media identifikasi lainnya) , dan tindakan percobaan oleh tamu, rombongan mereka atau pengunjung untuk mengadakan acara di properti vila Bali yang melanggar Persyaratan dan Ketentuan ini atau melanggar aturan apa pun yang berlaku untuk properti yang dipilih tamu. Dalam hal tamu membatalkan pemesanan yang dikonfirmasi, biaya pembatalan berikut umumnya berlaku:

  • 25% dari jumlah total sewa akan hangus jika pembatalan dilakukan lebih dari 60 hari sebelum dimulainya masa sewa
  • 50% dari jumlah total sewa akan hangus jika pembatalan dilakukan antara 30 dan 60 hari sebelum dimulainya masa sewa
  • 100% dari jumlah total sewa akan hangus jika pembatalan dilakukan antara 1 dan 29 hari sebelum dimulainya masa sewa.
  • No Show: 100% dari jumlah total sewa akan hangus

 

  1. PERUBAHAN / AMANDEMEN

Setelah konfirmasi pemesanan dikeluarkan oleh Asia Holiday Villa, biaya sebesar USD 50 akan berlaku untuk setiap amandemen yang dilakukan. Asia Holiday Villa akan melakukan yang terbaik untuk mengakomodasi perubahan yang wajar, tetapi tamu harus mengingat bahwa beberapa perubahan mungkin tidak dapat dilakukan.  Harap dicatat bahwa kebijakan amandemen ini berlaku untuk periode pemesanan reguler. Ketentuan amandemen khusus dapat berlaku untuk High season / Peak Season dan akan dinyatakan dalam deskripsi properti, konfirmasi pemesanan, atau voucher reservasi.

Jika informasi dalam salah satu dari ini tidak konsisten, ketentuan terbaru yang dikeluarkan akan berlaku. Jika Asia Holiday Villa tidak dapat mengakomodasi tamu alasan apa pun (termasuk penjualan properti dan force majeure) untuk memberi tamu properti yang dipesan, Asia Holiday Villa berhak untuk memindahkan tamu dan rombongan mereka ke alternatif vila lainnya dengan tipe dan nilai yang serupa, setelah berkonsultasi dengan tamu. Jika harga properti alternatif kurang dari pemesanan awal, perbedaannya akan dikembalikan kepada tamu. Jika harga properti alternatif lebih tinggi dari pemesanan asli, perbedaannya mungkin dibebankan kepada tamu. Namun, setelah upaya dari Asia Holiday Villa untuk tetap mengakomodasi permintaan tamu, apabila tidak ada alternatif dengan jenis dan nilai yang serupa tersedia dan / atau tidak ada kesepakatan dapat dicapai antara tamu dan Asia Holiday Villa, maka Asia Holiday Villa atau tamu dapat memilih untuk membatalkan pemesanan. Dalam hal itu, Asia Holiday Villa akan mengembalikan semua biaya yang sudah dibayarkan oleh tamu, tanpa kompensasi lebih lanjut.

  1. KELUHAN

Setiap upaya akan dilakukan agar tamu dapat menikmati masa menginap yang menyenangkan. Jika tamu memiliki masalah selama masa sewa, harap informasikan langsung kepada pemilik atau perwakilan pemilik, yang akan berupaya menyelesaikan permasalahan. Jika pemilik atau perwakilan pemilik tidak dapat mengatasi masalah tamu dengan memuaskan, harap segera menghubungi Asia Holiday Villa. Agar keluhan tamu dapat ditangani dengan baik, tamu harus mengomunikasikan masalah apa pun saat masih berada di lokasi. Jika tidak ada keluhan yang dilaporkan selama masa sewa, Asia Holiday Villa dan pemilik akan menganggap bahwa tamu merasa puas dan tidak keluhan setelah masa menginap dianggap tidak valid.

  1. PERSEDIAAN

Beberapa Akomodasi (Self Catering Accomodation) mengharuskan tamu untuk menyediakan semua persediaan dan perlengkapan yang diperlukan selama menginap. Staf di villa dapat mengakomodasi permintaan yang masuk akal untuk membeli beberapa persediaan untuk  tamu, dan biaya pembelian ini akan dibebankan kepada tamu

  1. TANGGUNG JAWAB ASIA HOLIDAY VILLA

Deskripsi, penilaian, dan / atau peringkat property  dan lokasi di sekitarnya yang diterbitkan atau diberikan oleh Asia Holiday Villa kepada tamu disediakan dengan itikad baik dan dengan keyakinan bahwa mereka akurat berdasarkan informasi terbaru yang diterima. Namun, Asia Holiday Villa tidak dapat bertanggung jawab atas modifikasi pada properti atau ketidakakuratan. Jika Asia Holiday Villa menerbitkan atau merujuk pada deskripsi, penilaian, dan / atau peringkat properti, baik oleh Asia Holiday Villa atau oleh pihak ketiga, peringkat ini hanya untuk tujuan informasi dan Asia Holiday Villa tidak akan bertanggung jawab atas kepercayaan yang ditempatkan pada penilaian ini.

  1. DISCLAIMER

Baik ASIA HOLIDAY VILLA, pemilik maupun manajemen villa tidak menerima tanggung jawab atau kewajiban untuk: cedera fisik, sakit, kematian, kehilangan, kerusakan, ketidaknyamanan, atau biaya tambahan yang dikeluarkan oleh tamu, pihak mereka, atau pengunjung terlepas dari penyebabnya; kendaraan apa pun atau konten kendaraan apa pun yang digunakan, disewa atau dipekerjakan oleh tamu atau pihak mereka selama masa sewa; Ketidakmampuan tamu atau anggota pihak tamu untuk memasuki lokasi properti villa mewah pribadi atau tinggal di properti untuk semua atau sebagian periode sewa sebagai akibat dari kegagalan untuk mendapatkan dokumentasi perjalanan atau visa yang sesuai, pembatalan, perubahan Agenda Perjalanan. gagalnya penerbangan, atau koneksi perjalanan; dan / atau penundaan atau pembatalan pemesanan sebagai akibat dari perang, ancaman perang, kerusuhan atau perselisihan sipil, pemogokan, demonstrasi, aktivitas teroris (terancam atau aktual), bencana alam, kebakaran, penyakit, kondisi cuaca, aksi di suatu bandara atau pelabuhan oleh otoritas pemerintah atau publik, masalah teknis terkait transportasi dan peraturan bandara yang disebabkan oleh gangguan teknis, mekanis atau listrik, atau masalah teknis, struktural, listrik, internet, pipa ledeng atau masalah dengan hewan disekitar properti atau kesulitan lainnya dengan Properti yang membuatnya tidak aman atau tidak dapat digunakan , atau keadaan lain apa pun yang berarti ‘force majeure’ atau Acts of God, atau peristiwa lain di luar kendali Pemilik. Dalam kasus apa pun Asia Holiday Villa, pemilik atau manajemen vila atau secara kolektif tidak bertanggung jawab untuk melakukan pembayaran atau memberikan pengembalian uang atau kompensasi dalam jumlah berapapun di atas jumlah total sewa yang dibayarkan

  1. YURISDIKSI

Perjanjian ini akan diatur oleh hukum INDONESIA. Jika terjadi kontroversi yang timbul dari pemesanan dan penyewaan properti yang tidak dapat diselesaikan secara damai antara para pihak, kedua belah pihak sepakat untuk secara eksklusif merujuk masalah tersebut ke pengadilan Indonesia untuk diselesaikan. Dengan membuat permintaan pemesanan, tamu setuju bahwa syarat dan ketentuan ini telah dibaca, dipahami, dan telah diterima dan disetujui oleh tamu tanpa reservasi dan tanpa pengecualian. Jika ada salah satu kondisi dari kontrak sewa ini menjadi atau menjadi atau dianggap tidak sah, atau jika ada penghilangan dari syarat dan ketentuan, syarat dan ketentuan yang tersisa akan tetap valid dan dapat ditegakkan dan tidak dapat ditentang.

Rates

All rates are quoted in USD or IDR and subject to change without prior notice.

Payments

A non-refundable deposit of 50% of the total rental amount must be received by Luxury Bali Destination to secure your booking within 5 days after confirmation of your reservation. Final payment is required 45 days prior to check-in date in low season and 60 days for high or peak season. If you make your booking within 45 days prior to check-in date in low season and 60 days for high or peak season, FULL payment is required to secure your booking. Your booking confirmation must be made by email or telephone (followed by written confirmation) and will be held provisionally for five days within which the payment has to be received into our account. If we do not receive within five days your provisional booking will be released. Payments can be made by either credit card or bank transfer. Based on payment policy, depends on the period of your stay, payment can be in two steps (deposit and final payment) or full payment. The issued INVOICE shall explicitly mention the amount due, and remaining balance to be paid later on. We have two different payment methods available. You can choose the one which is easiest in your situation.

  • Wire Transfer. International telegraphic transfer to our corporate bank account normally takes about three days. The amount transferred must include telegraphic transfer fees. If you choose to settle your payment by bank transfer, make sure that you allocate sufficient time before the due date.

In the case you are aware that your transfer payment may not reach our account in time, promptly notify us by sending (either emailed scan or fax) your transfer instruction receipt. Make sure that the receipt has bank’s authorization print-out. We have to receive the payment in full into our account. In the case arriving payment is slightly less than required in the INVOICE because of transfer fee, bank’s charge, currency loss, etc. you are required to pay the remainder either along with your final payment (if you are paying deposit) or in cash upon arrival.

  • Online Payment with Credit Card by Visa or Master. Online payment is the simplest and quickest way to settle your bill. Payment by credit card will be subject to 4% of credit card processing surcharge and will be charge in Indonesian Rupiah (IDR). Refer to Indonesian banking regulation requires all credit card transaction has to be made in Indonesian Rupiah. Therefore if you choose to pay by credit card, you will get your invoice pre-converted into Rupiah, refer villa’s prevailing exchange rate. We will send you a link which will direct you to online form where you will have to fill in your credit card details. Please keep your payment receipt in the case it required in the future. Reservation and payment process protected by SSL (Secure Sockets Layer) protocol, which provide fully security and liberty of online shopping.

Credit Card Authorization is required whether the Booker appointed other party (card holder) whom responsible for the accommodation payment.

As soon as we receive the payment, we will issue a BOOKING CONFIRMATION NOTICE within 24 hour, advising you that the villa is locked for your stay. It can be subject to further (final) payment.

Cancellations

Cancellation by Hire
Notice of booking cancellation must be received by Luxury Bali Destination in writing. Deposits will be refunded in full, less 20% of the total booking value if the reservation is cancelled 61 days or more prior to arrival in low season and 91 days or more prior to arrival in high and peak seasons. Cancellations less than 60 days or less before arrival in low season and 90 days or less before arrival in high and peak seasons do not qualify for any refunds. Please not that no refunds are made once final payment has become due.
Please note if multiple villas are booked, a cancellation fee will be applied for each villa.
Final payments are non-refundable.

Alterations and Cancellations by Us
In the unlikely event that a villa becomes unavailable due to circumstances beyond our control, we will offer alternative period if possible, alternative accommodation if available, or a full refund of all payments you have made. Refund is limited only to the rental costs. We are not liable to cover costs that may incur related to your travel arrangement i.e. administration fee to reschedule your flight, etc.

Amendment

Amendment to booking period can only be accepted upon availability of the villa. If your new period falls in different season where higher price is applicable, you will have to pay the additional cost accordingly. If your new period falls in different season where rental price is lower, no refund will be paid. If your new period is longer than your initial period, you will have to pay the additional cost. If your new period is shorter than your initial period, no refund will be paid. In any cases a US$50 administration fee is applicable and the new period will only be confirmed as soon as all payments related to the change are completed.

Villa Season

Most villas apply different rates depending on the season. Usually, three are 3 seasons low, high and peak. Please inquiry with our Holiday Team to get the exact dates for those seasons.

Airport Pickup

Some rates include airport pickups. Please check with your villa Holiday Team specialist.

Children Policies

Each villa property has different children policies, please communicate directly with our villa specialist regarding any requirements and limitations on number of children.

Villa Capasity

The numbers of person occupying a particular villa must not exceed the maximum number stated in the booking confirmation, otherwise there will be additional charge

Damages & Losses

Guests are responsible for keeping their rental villa in good condition and must reimburse Luxury Bali Destination for any damage or loss caused by them. Luxury Bali Destination reserves the right to request guests to immediately terminate their stay without accommodation refund of any kind if they have caused excessive damage to the property.

Liability

Asia Holiday Villa does not accept liability for any personal injury, illness, death, loss or damage of whatever nature suffered by you, or any member of your party, during the booking period or thereafter.
